Guiding Through Probate

When a person dies a personal representative has to deal with their estate whether they die with or without a Will. This procedure is called probate. Probate is the process of officially providing the validity of a Will.

If a person dies intestate (without a Will) there will be no named executors to carry out the deceased's wishes. Someone else will therefore have to take the responsibility and in order to do so legally they will have to obtain letters of administration.

If there is a Will, the named executors (in most cases, depending on the size of the estate) will need to obtain a grant of probate.
