Continuing Power of Attorney
What
is a Continuing Power of Attorney?
An
Continuing Power of Attorney is a legal document that enables someone
to appoint one or more people to manage their affairs should they
become mentally incapable of doing so themselves.
Naturally
the powers created are far ranging in that the attorneys are able
to deal with most financial matters on your behalf. Nevertheless,
most people like to take this step well in advance while they are
still in a position to appoint people that they would like to act
on their behalf should the need arise.
Details
of an Continuing Power of Attorney
The
attorney(s) only takes control of the donor's affairs if the donor
has become mentally incapable.
There
are several safeguards for the donor.
The
donor can cancel the power at any time before it has to be registered.
A power
may be in general terms or limited to specific acts or circumstances.
Because
the powers available to the attorneys are so wide ranging, these
documents need to be prepared according to strict regulations applicable
at the date of signing.
